Terms of Service

1. Acceptance of Terms

By downloading, installing, or using any Mircules application ("Apps"), including HAM QuickLog, DX Cluster, and other Mircules software, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Apps.

2. Eligibility

Our Apps are designed for licensed amateur radio operators. By using our Apps, you represent that you are at least 13 years of age and, where applicable, hold a valid amateur radio license.

3. Service Description

Mircules Apps provide amateur radio logging, DX cluster monitoring, and related functionality. Features include contact logging, import/export capabilities, and integration with third-party services. The Apps are intended for personal, non-commercial use only.

4. User Obligations

You agree to:

• Use the Apps only for lawful purposes
• Comply with all applicable amateur radio regulations in your jurisdiction
• Maintain accurate and truthful log entries
• Not attempt to reverse engineer, decompile, or modify the Apps
• Not use the Apps to transmit harmful, offensive, or illegal content
• Not use the Apps in any way that could damage or overburden our services

5. Intellectual Property

The Apps and their original content, features, and functionality are owned by Mircules and are protected by international copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Apps for personal purposes.

6. User Data

You retain full ownership of any log data you create using our Apps. By using cloud sync or backup features, you grant us permission to store and transmit your data as necessary to provide the service. You are responsible for maintaining backups of your data. We recommend regularly exporting your logs to ADIF format.

7. Purchases and Subscriptions

Some Apps or features may require a one-time purchase or subscription. All purchases are processed through the Apple App Store or Google Play Store and are subject to their respective terms and refund policies. Mircules does not process payments directly.

8. Third-Party Services

Our Apps may integrate with third-party services such as QRZ.com, HamQTH.com, Clublog, eQSL, and mapping services. These integrations are provided for your convenience. Mircules is not responsible for the content, accuracy, or availability of third-party services, and your use of such services is subject to their respective terms.

9. Disclaimer of Warranties

The Apps are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Apps will be error-free, uninterrupted, secure, or meet your specific requirements. We make no warranty regarding the accuracy or reliability of any information obtained through the Apps.

10. Limitation of Liability

To the maximum extent permitted by law, Mircules shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising from your use of or inability to use the Apps.

11. Data Loss

You acknowledge that you are solely responsible for maintaining backups of your data. Mircules is not responsible for any data loss that may occur due to device failure, software errors, user error, or any other cause.

12. Modifications to Service

Mircules reserves the right to modify, suspend, or discontinue any part of our Apps at any time without prior notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the service.

13. Termination

We may terminate or suspend your access to our Apps immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Apps will cease immediately.

14. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of significant changes by posting the new terms on this page and updating the "Last updated" date. Continued use of the Apps after changes constitutes acceptance of the new terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Apps shall be resolved in the courts of the Netherlands.
